Nebraska Leads Crypto Regulation: New ATM Fraud Prevention Law Requires Warning Disclosures

Enhanced Consumer Protection Measures Take Effect Amid Rising Fraud Concerns.

Nebraska has positioned itself at the forefront of cryptocurrency regulation with Governor Jim Pillen's recent signing of LB609, officially known as the "Controllable Electronic Record Fraud Prevention Act." This bipartisan legislation aims to combat the growing issue of cryptocurrency ATM fraud while simultaneously establishing Nebraska as a leader in the digital asset space.

The new law, which was introduced by Senator Eliot Bostar in January, imposes stricter requirements on cryptocurrency kiosk operators. These businesses must now obtain licenses under the Nebraska Money Transmitters Act and provide comprehensive disclosures to users, including explicit warnings about potential fraud schemes.

"Cryptocurrency is an emerging industry, and we've been working hard to build Nebraska into a crypto leader," Governor Pillen stated on X. "We want everyone to know that we're open for business — and that we're doing it the right way."

The legislation comes amid mounting concerns over cryptocurrency ATM vulnerabilities. Kelly Lammers, Director of the Nebraska Department of Banking, emphasized the state's proactive stance: "Of course, those that target our citizens, that look to exploit Nebraskans and their financial resources, using Crypto ATMs as part of their transfer method, we will soon have a team that will be watching even more closely."

This regulatory development follows a troubling trend identified by the Federal Trade Commission, which reported a "massive increase" in consumer losses related to Bitcoin ATM scams. According to the FTC, fraud losses connected to Bitcoin ATMs exceeded $65 million in just the first half of 2024.

Nebraska's initiative mirrors federal efforts to address this issue. In late February, Senator Dick Durbin introduced the Crypto ATM Fraud Prevention Act, which similarly seeks to reduce fraudulent activities involving cryptocurrency kiosks.

By establishing these "guardrails," as Governor Pillen described them, Nebraska aims to create a secure environment for cryptocurrency transactions while preventing criminals from exploiting vulnerable consumers.
